Terms of Service

This Terms of Service (“Agreement”) is a legal contract between you (“User”) and Modular Technology Group, LLC (“Modular,” “we,” “our,” or “us”). By creating an account, purchasing a subscription, or using the Image‑to‑Alt‑Text Generator (the “Service”), you agree to be bound by all terms below.

1. Service Description

The Service converts user‑supplied image files into suggested alternative text (“alt text”) using artificial‑intelligence models. A paid subscription provides up to 200 image credits every 30 days. Credits do not roll over; unused credits expire at the end of each 30‑day period (“use it or lose it”).

2. Acceptance of Terms

Use of the Service constitutes full acceptance of and agreement to this Agreement. If you do not agree, do not use the Service.

3. User Responsibilities

  • Accuracy Review. AI models can and do make mistakes. You must review, edit, and approve all generated alt text before publishing or otherwise using it.
  • Copyright Compliance. You may upload only images for which you own the rights or have obtained all necessary permissions. You are solely responsible for any copyright or intellectual‑property infringement arising from content you provide.

4. Payment, Renewal, and Refunds

  • The subscription fee is $5.00 USD per 30‑day period and includes 200 image credits.
  • Once 10 or more images have been processed in a given 30‑day period, the subscription is non‑refundable for that period.
  • You may cancel at any time; cancellation stops future renewals but does not trigger a prorated refund for unused time or credits.
  • At the end of each 30‑day period, your subscription will automatically renew and your credit balance will reset to 200, provided payment is successful.

5. Limited Liability

To the maximum extent permitted by law, Modular will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or relating to your use of the Service.

6. Disclaimer of Warranties

The Service is provided “as is” and “as available.” Modular makes no warranties, express or implied, regarding the accuracy, reliability, or fitness for a particular purpose of any generated alt text.

7. Indemnification

You agree to defend, indemnify, and hold harmless Modular from any claims, damages, or expenses (including attorneys’ fees) arising out of your use of the Service, your violation of this Agreement, or your violation of any rights of a third party.

8. Force Majeure & Severability

Modular is not liable for failure to perform due to causes beyond its reasonable control, including but not limited to natural disasters, strikes, or internet outages. If any provision of this Agreement is held invalid or unenforceable, the remaining provisions will remain in full force and effect.

9. Governing Law

This Agreement is governed by and construed in accordance with the laws of the Commonwealth of Kentucky, United States, without regard to its conflict‑of‑law principles. Any dispute shall be resolved in the state or federal courts located in Kentucky.

10. Changes to Terms

Modular may modify these terms at any time by posting an updated version on the Service website. Continued use after changes become effective constitutes acceptance of the revised terms.
